This was the law that unlocked ADUs statewide. Key provisions: cities and counties must allow at least one ADU and one JADU on every single-family lot. They cannot require owner-occupancy as a condition of building. Minimum size standards cannot be used to effectively prohibit ADUs. This overrode decades of local restrictions overnight.
Cities must approve or deny ADU permits within 60 days. ADUs can be up to 850 sq ft (studio/1BR) or 1,000 sq ft (2BR+) regardless of local zoning. Setback requirements for ADUs converted from existing structures are capped at 4 feet from rear and side property lines.
Homeowners can now split their single-family lot into two parcels and build up to 2 units on each — potentially 4 units total where only 1 existed before. This is a major opportunity for larger properties, especially for real estate investors.
